The purchase of the Energy Certification Service offered through the website www.tinsa requires acceptance of the Terms and Conditions set forth in this document, which the Customer acknowledges having read prior to the electronic execution of the contract.
These contracting conditions may be updated and/or modified whenever Tinsa deems appropriate. If the updating and/or modification of the same should lead to variations in the contractual relationship with the Client, Tinsa shall maintain the contracting conditions in force at the time of formalizing the contract.
2. Customer Definition
A Client is considered to be a natural or legal person, with the capacity to contract according to the legislation applicable to them in accordance with their nationality, who registers through the form provided for this purpose, and requests a service.
The provision of personal data and the purchase of products through our portal requires to be of legal age, according to Spanish law, and to have the necessary legal capacity to contract by itself the services offered on this Web Site.
The services are provided to the customer in their capacity as the recipient or end user thereof; the resale or commercialization of the Service, as well as the assignment of the contract, is strictly prohibited without the express authorization of Tinsa Certify S.L.U.
3. Service definition
Energy Efficiency Certification is a service provided by Tinsa Certify S.L. that results in an officially recognized document summarizing Property energy performance, in accordance with the parameters established by the Ministry of Industry, Energy, and Tourism. To fulfill legal requirements, the company also offers services to facilitate registration in the registry maintained by the competent authority designated by each autonomous community.
The service represents the possibility for an owner (natural person or legal entity) to request a Property, in order to comply with the legal requirement established by the Royal Decree 235/2013 approved on April 13, 2013, by being able to have the analysis of the characteristics and condition of the Property, objectively, by a qualified professional.
The service is developed through the application of a defined and approved methodology, supported by a computer application specifically developed as a tool for the calculation and generation of Energy Certificates, at the request of the Ministry and provided by the same.
There are several software programs approved and recognized as valid by the Ministry of Industry, Energy, and Tourism, with minor differences that make some more suitable than others depending on whether they are used for project certification, New-build or existing buildings, and depending on the complexity and size of the Property be certified.
Tinsa Certify selects the programs it deems appropriate based on specific needs. For existing buildings, CE3X is considered the most appropriate tool.
The aspects analyzed focus on those elements and characteristics that most directly affect energy efficiency and therefore emissions and energy consumption.
4. Methodology
4.1. The data used to prepare the energy certificates are as follows:
The ratings, established on a letter scale from A to G, are the result of a check carried out by a technician, after an organoleptic inspection of the Property and an analysis of the location and elements of the environment where it is located.

4.2. Content of the Energy Performance Certification of existing buildings
Once the data has been collected, the calculations have been made and all the influencing factors have been analyzed and entered into the approved computer application, a PDF is generated with the Energy Efficiency Certification report, which shows the following resulting information:

- Data of the Certifying Technician
- Global Energy Rating Carbon Dioxide Emissions
On a scale of letters according to areas of emissions in (KgCo2/m2 year) establishing a category of sustainability and energy efficiency

4.3. Content of the Energy Efficiency Certification Label for Existing Buildings
A single document with a regulated and equal format throughout the national territory that must be submitted by the competent Official Bodies determined by each Autonomous Community for the registration of Energy Efficiency Certifications of existing buildings.

4.4. Scope of the results obtained
The Energy Efficiency Certification report does not include the study of the structural, constructive or installation elements of the building in which the dwelling under study is located.
All indicators are analyzed on the basis of a limited ocular inspection. In no case are tastings, surveys or specific tests carried out to determine the exact state of conservation of the Property. The scores are consequently determined according to the state that can be presumed from the analysis of these indicators based on the external appearance of the same without regard to the existence of defects or hidden defects.
5. Validity of the report
Royal Decree 235/2013 establishes the validity of the Certificate and Label with the resulting ratings and data for said Property shall be understood to be valid for a period not exceeding ten years. Whenever reforms, modifications or implementation of improvements are carried out on the Property or its environment undergoes modifications of the factors affecting the consumption conditions analyzed at the time of certification, there may be variations with the ratings that take into account these new conditions and characteristics, since the technician issues the Certificate according to data taken at a specific time. The Royal Decree defines the competence of the Autonomous Communities to regulate the terms of convenience or obligation to adapt or update the energy certifications in the event of significant modifications of the factors influencing the rating and Energy Efficiency data.
6. Service Delivery Process by online channel
The service of issuing energy certifications through the online channel is only available for individual properties of up to 500 m2.
The service request will be made by filling out the electronic application form in which you must fill in the data of the Property for which you are requesting the energy certification.
The form will only accept service requests from properties within the typologies that are under the obligation to carry out the Energy Certification, since they are those that require energy consumption for their conditioning and operation due to habitability or public concurrence.
In the case of a building or a Property with a larger surface area, or in the case of unique or highly complex properties, an ad hoc quotation must be requested through our web service for the contracting of the service.
The service request shall be made by completing the electronic application form, in which you must fill in the details of Property Certification is requested. (All campos included therein are mandatory unless otherwise indicated).
Once the requested data has been filled in and once it has been determined whether only the certification is requested or the registration management is also requested, and before proceeding to the purchase process, the program will show the prepared estimate and you will be asked to fill in your personal data or the user name and password with which you are registered on the Web.
At this moment the customer will be shown the contracting conditions and privacy policy, which must be read and accepted.
Once the application data has been verified, you will be shown the screen corresponding to the payment platform, where you will proceed to pay for the service, in accordance with the provisions of section 9 of this document.
Once the payment has been made, the service will be understood to be contracted and the purchase of the service will be confirmed by sending an email to the email address provided.
7. Preparation and delivery of the Report
The assigned technician will contact the person indicated in the request within 24 to 48 hours (excluding Saturdays and holidays), during which time the visit will be arranged.
The visit will take place in the shortest possible time, determined by the availability of the person designated by the applicant to provide access to the Property and the technician's commitments according to the order of entry of service requests.
Once the visit of the technician has been made and within a maximum of two or three days* (excluding Saturdays and holidays), the Energy Efficiency Certificate of the Property will be automatically sent to the e-mail address you have provided us with.
If the registration management has been requested, the Certificate will be registered in the corresponding official organism, and depending on the response time of each Autonomous Administration, the corresponding Energy Label will be delivered.
8. Price of the service
The price of the certification depends on the use, residential or tertiary and its surface. The prices that respond to special promotions will be expressly indicated as responding to a promotion.
Tinsa Certify reserves the right to end this promotion and restore the original prices.
The price of the service will be shown in the quotation that will be shown prior to contracting.
9. Form of Payment
Tinsa has enabled an electronic payment system through payment by credit card or debit card (Visa and MasterCard) and Bizum. To make the payment you must indicate directly in the area provided for this purpose (secure and protected by maximum privacy through SSL encryption: Secure Socket Layer) the card number without spaces, its expiration date and the security code of the card through the Ogone/Ingenico Payment Services platform.
The user of the website is responsible for transactions made by card or other means of telematic payment. By your authorization you confirm that the payment numbers and details are correct, that neither the card nor the account is reported as lost or stolen, and that the funds are available at the time of payment.
The commitment to pay using a credit card is irrevocable. It is possible to oppose its use only in case of loss, theft or fraudulent use of the credit card. Except in such cases, the credit card holder, depending on the situation, may be considered guilty of fraud if he/she objects to the previously authorized payment.
If the card has a password protection (Verified by Visa / MasterCard SecureCode), you will be redirected to the web page of the card issuing bank to authorize the transaction. For payments made with cards issued outside Spain, the issuing bank must be a member of the Secure Electronic Commerce Security Protocol (CES). Payments with cards that do not comply with this requirement will not be accepted.
The charge on the card will be made online, live, that is, at the time of sending the payment form data. In the event that the payment platform informs that the card has been denied, the order will be automatically cancelled, informing the customer of the cancellation online and at the moment.
To pay with Bizum, enter the phone number associated with the service and the password for online purchases of BIZUM (If you still do not have your password you can request it in the app of your bank). You will receive an SMS with a confirmation code that you must enter in the payment window and complete the payment. Minimum amount for the use of the service (0,50€). The possibility of using this service will be subject to the availability of each bank to make online purchases with BIZUM.
The payment of the fees determined on the website for the different services offered does not give the Client any other type of right than the one determined in the present general contracting conditions or in the particular conditions of each of the services offered.
Once the payment has been made, the service will be understood as contracted.
10. Invoice
In accordance with the provisions of Article 164(1)(3) and (2) of Law 37/1992 of December 28, the Value-Added Tax Law, the Customer hereby consents to Tinsa Certify S.L.U. issuing the corresponding invoice in the Customer’s name in electronic format, as well as to said invoice being sent electronically to the email address provided at the time of entering into the contract with Tinsa Certify S.L.U.
The Customer may revoke their express consent to receive electronic invoices at any time. To do so, they must send an email to the following address: tinsa_certify@tinsacertify.es, providing the information used to sign up for the service and indicating their preference to receive paper invoices.

11. Responsibility
The results contained in the Energy Performance Certificate have been obtained on the basis of a limited ocular inspection and therefore constitute a limited analysis of the state and characteristics of the Property. On the other hand, some of the parameters used in the preparation of the report have been obtained by direct information from the applicant himself or from third parties, when the impossibility of its verification has been accredited.
It is also noted that the internal calculations used to determine the ratings are independent of Tinsa Certify and the technician, as they are performed using an application regulated and approved by the Ministry of Industry, Energy, and Tourism, which sets the rating parameters included in the report in a manner that cannot be altered.
It should be noted that the certificates issued are not a valid document to support the adoption of decisions outside the field of energy efficiency qualification.
Tinsa Certify and the professionals involved in providing the Energy Certification service shall not accept any liability for any damages that may arise for the service applicant as a result of decisions that do not take into account the circumstances and scope of the findings in the report issued in accordance with the above.
In any event, the maximum liability that Tinsa Certify and the professionals who participated in the issuance of the certificates may incur toward the Client for any damages (including direct damages, legal fees, or expenses of any other kind) for which they might be held liable in connection with the services provided shall, in any case, limited to a maximum amount equal to twice the fees received by Tinsa Certify S.L. in consideration for its services. Under no circumstances shall the professionals involved in preparing the report be liable for personal injury, indirect damages, loss of profits, or loss of business opportunities that may arise for the Client or third parties in connection with the services provided.
12. Validity and duration
The contract will come into force and take effect from the moment of acceptance by the Client and payment of the service. The contract will have a defined duration, which will be given by the receipt by the Client of the response to the contracted service.
13. Withdrawal
The Customer may withdraw from the contract within 14 days from the date of conclusion of the contract, without having to justify the reasons for withdrawal.
In order to exercise their right, and always within the period established in the previous section, unless the service has already been fully executed, the Customer may use the model withdrawal form that they consider most appropriate, or make an unequivocal statement that records their decision to withdraw from the contract. In any case, the Client may request Tinsa to provide a model withdrawal form, or any other type of information on this aspect.
However, in the case of a service provision, which has also been prepared on the basis of the customer's particular specifications, we expressly inform you, in compliance with art. 103 of the Consumer Law, that this right of withdrawal shall not apply if the service has been fully performed.
To this effect, the customer is informed that the acceptance of these conditions implies the express consent of the customer to immediately start the requested services and determines that the customer knows and accepts that once the service has been completed, even if 14 days have not elapsed, he/she will not have the right to cancel and/or return the service provided.
If, once the service has commenced, the client has the right to withdraw from the service and requests it under the terms referred to in the previous sections, Tinsa will refund a proportional amount of fees attributable to the part of the service already provided at the time Tinsa is informed of the withdrawal in relation to the total object of the contract. The proportional amount to be paid shall be calculated on the basis of the total price agreed in the contract.
Once the order has been placed, if the client cancels it, he/she will be obliged to pay a minimum of 60 euros, as administration costs (generation and cancellation of the order and the steps for the return of the fees).
Likewise, after the visit to the Property , the client is obliged to pay a minimum (without prejudice to a higher percentage) of 50% of the contracted services, as compensation for damages caused by the cancellation.
14. Confidentiality
Tinsa Certify S.L.U. undertakes to treat any information to which it has access in the course of providing its services as confidential.
15. Security Policy
Tinsa Tasaciones Inmobiliarias, S.A.U. guarantees security in all communications with its customers. All data operations are carried out on a secure server, based on the SSL standard, which by means of an encryption system, makes it impossible to access the data against attempts of violation by third parties.
16. Applicable law and jurisdiction
In all matters not provided for in these general conditions and in the particular conditions governing each of the services offered, the contract shall be governed by the Spanish laws in force.
Any dispute that is not resolved amicably shall be subject to the jurisdiction of the Courts and Tribunals of Madrid, for any Customer who is not a consumer or user according to the definition given by the Spanish sectorial regulations and those determined according to the current rules of procedural distribution for consumers and users who are natural persons.

The report does not perform any verification in relation to other limitations or conditions that may affect the Property by application of sectorial regulations (urban, VPO, limitations derived from the coastal law, road) nor does it consider whether the same has the relevant licenses and whether or not it complies with the parameters of habitability.

Validity of the report

Once you have filled in the requested information and indicated whether you are requesting certification that includes registration services, and before proceeding to checkout, the program will display the quote. The customer will also be shown the general and specific terms and conditions for the service, as well as the privacy policiesof Tinsa Tasaciones Inmobiliarias and Tinsa Certify S.L., which must be read and accepted.
Once the conditions have been accepted, you will be asked to confirm the correctness of the data entered in the application. If they are not correct, you will be allowed to correct them before continuing with the contracting process.
Once the application details have been verified, you will be taken to the payment platform screen, where you can proceed to pay for the service. The electronic payment system is carried out by card through the Santander payment platform Santander has beencontracted to handleelectronic payments for this service.
The payment screen will show the amount to be paid with reference to the contracted service and will ask you to provide the following data:
- Number of the card with which payment is to be made
- Expiration date
- Security code
Once entered you can choose to continue with the purchase process by clicking on the option "Buy. Accept payment", modify the data by clicking "Delete. Clear data" or cancel the purchase by clicking "Cancel. Go to the store".
After clicking on the "Pay" option, the service will be understood to be contracted. Once the purchase of the service has been accepted, the user will be shown the data entered as payment method, with a reference for any query to the entity through which the electronic payment is made, data that can be printed if desired, along with the invoice, if it has been requested.
In the event of having to pay for the estimate in advance, you will be provided with an account number where you will be able to make the corresponding payment.
OnceTinsa Certifyreceives confirmation of payment—whether through the payment platform or via bank transfer—your request will be accepted.
Given that the service is a personalized service and is executed automatically within a short period of time after contracting it, the right of withdrawal of contracts concluded at a distance does not apply to it.

Under no circumstances shall the professionals involved in preparing the report be liable for personal injury, indirect damages, loss of profits, or loss of business opportunities that may arise for the Client or third parties in connection with the services provided.
* As long as we have the necessary documentation (see attached document) and the relevant town planning consultations have been carried out if required by the technician when performing the Appraisal of the Property to be appraised.
